I am Donald C. Nemec. I have been practicing family law in the state of Texas since 2008. I have offered an agreed divorce package since I first began practicing, after learning the exorbitant fees charged by attorneys for agreed divorces. I developed this service for people who want professional level service provided by an attorney without spending their children’s college fund on finding peace.

Mr. Nemec has been practicing law in Texas since 2008. Valuable insight is gained through 17+ years concentrating in discrete areas of law. He knows the law. He knows most of the family court judges in North Texas. And he knows many of the other attorneys in Tarrant, Dallas, Collin, Denton, Johnson and Parker Counties and beyond. Mr. Nemec suffered a personal tragedy in Spring, 2022 when his wife and mother of his three teenage children unexpectedly passed away. As a result of this shock, Mr. Nemec closed his office for a period of time. He has since grown and focused on raising his beautiful children and building this law practice to be the best it can be. Since October, 2022, we are happy to report that the Law Office of Donald C. Nemec is now more organized, better staffed, and one of the most procedurally efficient law firms in the area.


Donald Nemec is licensed to practice law in all Texas state and district courts, including all federal bankruptcy, civil, and criminal courts for the Northern District of Texas. He primarily practices in family law, but also practices bankruptcy, estate planning, probate, and dabbles in a few other areas of the law.

OPTION 1

Pro Se Divorce Service - Documents, Instructions, and Guidance


Attorney Serviced Agreed Divorce Service

Mr. Nemec has been providing this low cost $650* divorce service since 2008 to facilitate hundreds of divorces throughout Texas. The service is designed for divorcing couples who can agree on all property and parenting issues within 60 days after filing for divorce. Our law firm does not represent either party in the divorce. Instead, we will provide you with all fully completed customized paperwork, step-by-step instructions on how to file and complete the divorce, procedural guidance, and support.


Process - What to Expect

You can start the process by completing our questionnaire. After completion and receiving payment, Mr. Nemec will create and provide you with all paperwork and detailed instructions to file and complete your divorce. Turnaround time is typically 7 days. Only one hearing should be required, it will occur after the 60 day cooling off period, might be via Zoom video, is very simple, and we provide 100% support to eliminate the unknowns and intimidation. (Note that we do not attend the hearing with you, but give you complete instructions and a written script to read to the judge.)


You and your spouse will need to come to agreement on any disputed issues before you finalize the divorce. Please note that this service does not include negotiations or mediation work. Those services are available at an additional charge if needed and if agreed to by the Attorney. Cost and Payment


Legal Fee

The price for the Pro Se Divorce Legal Service is $650*. The payment can be made online at www.nemeclaw.com/pay. As discussed, that payment is due in full before we get started on the paperwork.


*Add $180 if minor children of the marriage ($800 total). If you have an existing child support order, you will need to email a PDF copy of such order to Mr. Nemec at dcnemec@nemeclaw.com.


*Add $180 if you have real property or more than two vehicles to divide in the order. This service does not include extensive detailed property or debt division provisions. However, add-ons are available if necessary. Pre-pay $90 and schedule an appointment if you would like to discuss add-on options. When scheduling the appointment, be sure to provide us with a detailed description of the property/debt that needs to be divided. Mr. Nemec will review your information and provide you with a flat rate quote for the add-ons


Filing Fee and Waiver of Filing Fee

The court charges a filing fee of approximately $360-$450 to file the case. However, the court will waive the filing fee if you can show that you cannot afford it. If your monthly income and expenses are about the same and you can show on paper that you have little or no disposable income after paying all of your expenses, then the court should waive your filing fees. We will provide you with the waiver application for you at no additional charge. Please also be advised that the court might require you to show the judge proof of income, bills, and receipts to prove that you cannot afford the filing fees. 


Alternatively, you can just pay the filing fee directly to the court clerk at the time you file the divorce.

OPTION 2

Full Representation Agreed Divorce Service


Alternative full representation agreed divorce service:

Mr. Nemec also offers a flat rate fee uncontested full representation divorce service, for a simpler and less stressful experience. This full representation service includes much more than just documents, instructions, coaching, and scripts, as in the Pro Se Divorce Service option. In this service, you would still need to negotiate an agreement with your spouse without our mediation or negotiation services. In this service, Mr. Nemec would draft all documents, file them with the court, and attend the final hearing with you. You would just need to complete the questionnaire for us, assist in obtaining your spouse's signature on two documents (one notarized), and appear at court with the attorney after the 60 day waiting period (if necessary). The total legal fee for this service is $1,200*, as long as your spouse signs and returns the paperwork. Be advised that you would need to pay the full filing fee before we file if you hired me to represent you in full. 


There is a filing fee of $360-$450 that would need to be paid in addition to the $1,200* legal fee before the case is filed.

*Add $180 if you have real property or more than two vehicles to divide in the order. This service does not include extensive detailed property or debt division provisions. However, add-ons are available if necessary.


*Travel fee extra for certain counties. Flat rate fee applies only to Tarrant, Dallas, Denton, Collin, Bexar, Harris, and other Texas counties that do not require a personal prove-up appearance. Additional travel fees @ $180/hour roundtrip from DFW airport north apply to all personal appearances.


If you and your spouse are unable to reach an agreement on all issues and this becomes a contested matter, we could elect to help with a contested divorce, at the Attorney’s sole discretion. Mr. Nemec typically requires a deposit of $1,500 for a contested divorce and would provide flat rate quotes for legal services whenever possible.

If Spouse Cannot be Found

In either case (pro se service or full representation), the court will require you to attempt to locate your spouse before finalizing the divorce. If you cannot find him/her after searching social media sites and contacting any relatives/friends who might have their contact information, then we could prepare the paperwork to request the judge to allow the posting of the lawsuit at the courthouse instead of personally serving them and having them sign the documents. The additional fee for this service would be $600 flat rate. Please first try to find your spouse and prepare a statement describing your due diligence.
