Attorney Serviced Agreed Divorce Service

The Law Office of Donald C. Nemec has provided this $550* divorce service for over eight years and has facilitated hundreds of divorces throughout Texas. The service is designed for couples who can agree on all property and parenting issues within 60 days after filing for divorce.

The attorney does not represent either party in the divorce. Instead, the attorney will personally draft and provide you with all fully completed customized paperwork, step-by-step instructions on how to file and complete the divorce, procedural guidance, and answer all questions regarding laws and and how a judge would probably rule given your circumstances.

This limited scope legal service does not include full representation and the purchase of this service does not create an attorney-client relationship. However, the attorney will be available to answer questions until your divorce is finalized.

Process - What to Expect

You can start the process by completing my questionnaire. After receiving the questionnaire data and payment, the attorney will create and provide you with all paperwork and detailed instructions to file and complete your divorce (7-day turnaround time). Only one hearing is usually required during your divorce. It will occur after the 60 day cooling off period, is very simple and we provide 100% support to eliminate the unknowns and intimidation. (Note that we do not attend the hearing with you, but give you complete instructions and a script to read.) 

You and your spouse will need to come to agreement on any disputed issues before you finalize the divorce. Please note that this flat rate agreed divorce service does not include negotiations or mediation work. Those service are available at an additional charge if needed, and if the attorney agrees to perform such services in your case.
 

Cost and Payment
Legal Fee

The price for the legal service is $550 without children or $650 if you have children and do not yet have child support established through the Attorney General. The payment can be made online or in person and is due when you get started. I can email you an invoice to make payment online.

*Additional $100 for divorces with children (total fee = $650 for a divorce with children). The additional $100 does not apply if you already have child support established through the Attorney General. You need to provide our office with a copy of your most recent child support order if you do have child support established.

Filing Fee and Waiver of Filing Fee
The court charges a filing fee of approximately $340 to file the case. However, when you represent yourself in a court case, the court will waive the filing fee if you can show that you cannot afford it. If your monthly income and expenses are about the same, that is, you have little or no disposable income after paying all of your expenses, then the court should waive your filing fees. Please make sure you complete the financial statement portion of the questionnaire if you think you qualify and the attorney will create the waiver application for you at no additional charge. Please also be advised that the court might require you to show the judge proof of income, bills, and receipts to prove that you cannot afford the filing fees.
